Terms and Conditions of Sale
1. Purpose
These terms and conditions of sale (T&Cs) govern the contractual relationship between HelveDrone (a simple partnership, Miguez Stéphane and Lombardi Alexandre) and any client placing an order for an aerial drone photography or videography service.
2. Booking
Any booking becomes final upon written confirmation from HelveDrone, unless otherwise agreed in writing between the parties.
3. Weather conditions
Aerial drone photography depends on favourable weather conditions (wind, precipitation, visibility). If conditions on the agreed day do not allow for a safe flight, the service is postponed free of charge, with no additional fees, to a new date agreed with the client as soon as possible.
4. Cancellation
Any cancellation by the client more than 48 hours before the agreed date incurs no fees.
Any cancellation within 48 hours of the agreed date may result in the full amount of the service being charged.
HelveDrone reserves the right to cancel a service in the event of force majeure or a proven danger to flight safety; in this case, the service is postponed to a new date or cancelled at no cost to the client, at the client's choice.
5. Delivery
The delivery times indicated in each package run from the date of the service. Any significant delay will be communicated to the client as soon as possible.
6. Image rights and intellectual property
The images and videos produced remain the intellectual property of HelveDrone. The client has a right of use according to the package chosen (personal use or commercial usage rights, depending on the plan purchased).
Unless the client explicitly refuses in writing before or after the service, HelveDrone reserves the right to use all or part of the images and videos produced for communication and promotional purposes (portfolio, website, social media).
7. Liability
HelveDrone employs all necessary means to ensure the safety and quality of its services, in compliance with current FOCA regulations. HelveDrone cannot be held liable for the impossibility of carrying out certain filming due to regulatory restrictions, refusal of authorisation, or unforeseen circumstances beyond its control.
8. Applicable law and jurisdiction
These T&Cs are governed by Swiss law. In the event of a dispute, and failing an amicable resolution, the courts of the Canton of Valais shall have exclusive jurisdiction.
9. File retention
HelveDrone retains raw footage and unedited files for 3 months after final delivery, as a backup. After this period, these files may be deleted without notice. The client is responsible for keeping a copy of the final deliverables provided to them.
10. Third-party image rights
For event-based services (weddings, festivals, public or private events), it is the client's responsibility to inform those present that a drone is carrying out aerial filming and, where applicable, to obtain their consent in accordance with applicable data protection and image rights regulations. HelveDrone cannot be held liable in the event of the client's failure to fulfil this obligation to inform.
